This is the letter/opinion written by Kathleen Heaney addressed to Sheriff Joel Brott. This is in regards to law enforcement coverage for Baldwin Township if incorporated.

The sheriff’s office has the ability to enforce criminal laws even if the incident occurs within a municipality.  Op. A.G. Oct 14, 1997.  A city has the ability to establish a law enforcement unit.  This conclusion is drawn from a number of statutes and case law.  For example, a city may contract for services of another law enforcement agency for coverage.  MS 436.05. (see also MS 626.84 that provides that a peace office is an appointed  official or employee of a political subdivision. )  However, it is not a requirement that a city have a law enforcement unit.  See, Dahlheimer vs. City of Dayton, 441 NW2d 534,537 (MN App. 1989)(Citation omitted;challenged on other grounds; and held that a municipality may not be held liable for failure to supply general police or fire protection.); and MS 299C.72 which allows the Sheriff’s Office to run criminal histories for city purposes where there is no police department. 

So if Baldwin incorporates into a city, they do not have to have a police department.  However, if they desire to have dedicated law enforcement or coverage greater than what you would provide to the remainder of the unincorporated areas, then they, like Zimmerman, will need to enter into an agreement and pay for the same.  And absent a contractual agreement, they do not have ANY authority to direct/request a specific level of service.

The Town Board finds that clarification is necessary regarding certain comments made at the Incorporation Public Comment meeting on March 7, 2024.  The Princeton City Administrator stated the City is not requesting annexation of areas of Baldwin Township at this time.  This is not factually correct.  The submission by the City to the Court opposing Baldwin Township’s petition states that they are requesting annexation of 9,740 acres of Baldwin Township if incorporation is granted.  If incorporation of Baldwin Township is not approved, it remains a fact that plans adopted by City outline annexation of areas of Baldwin Township to be served by municipal sanitary sewer and water.   Relevant sections of the document submitted by the City to the Court is linked below for review.  The Mayor, Princeton City staff, and consultants employed by the City of Princeton testified to the Court as to these facts under oath on March 8, 2024.
